These Terms and Conditions ("Terms") govern your membership with Black Bear Shooting Club ("BBSC") and your use of the facilities, services, and programs offered at Black Bear Shooting Complex. By applying for membership, visiting our facilities, or using our services, you agree to these Terms. Please read them carefully.

 

1. DEFINITIONS

1.1. "BBSC" refers to Black Bear Shooting Club, its owners, officers, employees, and authorized agents.

1.2. "Complex" refers to Black Bear Shooting Complex, the tactical facility operated by BBSC.

1.3. "Member" refers to any individual who has completed the application process, been approved, paid all required fees, and maintains active membership status with BBSC.

1.4. "Guest" refers to any non-member who accesses the Complex under the sponsorship of a Member.

1.5. "Facilities" refers to all property, buildings, ranges, and amenities owned or operated by BBSC within the Complex.

1.6. "Rules and Regulations" refers to the BBSC Rules and Regulations document, as may be amended from time to time.

1.7. "Standard Operating Procedures" or "SOPs" refers to the operational guidelines and safety procedures established by BBSC, as may be amended from time to time.

 

2. ASSUMPTION OF RISK

2.1. Member acknowledges that the use of firearms and participation in precision shooting sports and related activities are inherently dangerous and involve significant risks, including but not limited to the risk of serious injury or death.

2.2. Member voluntarily and expressly assumes all risks associated with the use of the Complex Facilities, including but not limited to:

• Injuries caused by firearms, ammunition, or related tactical equipment

• Injuries caused by ricochets, splatter, or falling brass

• Injuries caused by noise exposure

• Injuries related to weather conditions or terrain

• Injuries resulting from the actions or negligence of other persons

• Exposure to lead and other potentially harmful substances

2.3. Member understands that BBSC cannot eliminate these inherent risks even with implementation of proper tactical safety protocols.

 

3. RELEASE AND WAIVER OF LIABILITY

3.1. Member hereby releases, waives, and discharges BBSC from any and all liability for any loss, damage, injury, or death, including claims based on negligence, that may be sustained by Member or Member's property while at the Complex or participating in BBSC activities.

3.2. This release extends to any claim or demand on account of injury to or damage to Member or Member's property, whether caused by negligence of BBSC or otherwise, while Member is in or upon the Complex or participating in any BBSC activity.

3.3. Member agrees to indemnify and hold harmless BBSC from any loss, liability, damage, or cost that BBSC may incur due to Member's presence at the Complex, whether caused by negligence of BBSC or otherwise.

3.4. This release and waiver specifically includes claims related to communicable diseases and environmental conditions.

 

4. COMPLIANCE WITH RULES AND REGULATIONS

4.1. Member agrees to abide by all BBSC Rules and Regulations and Standard Operating Procedures, which are incorporated into these Terms by reference.

4.2. Member acknowledges receiving, reading, and understanding the BBSC Rules and Regulations and Standard Operating Procedures.

4.3. Failure to comply with Rules and Regulations or SOPs may result in immediate removal from the premises, suspension, or termination of membership without refund.

4.4. Member agrees to follow all directives given by BBSC Range Safety Officers and operational staff.

 

5. MEMBER CONDUCT AND RESPONSIBILITIES

5.1. Member agrees to conduct themselves in a tactically sound, responsible, and professional manner at all times while at the Complex.

5.2. Member agrees to report any unsafe conditions or behaviors to BBSC staff immediately.

5.3. Member agrees to properly dispose of all tactical debris, spent brass, and other waste in designated receptacles.

5.4. Member agrees not to be under the influence of alcohol or drugs while at the Complex.

5.5. Member agrees to properly supervise any junior shooters or guests they bring to the Complex.

5.6. Member agrees to use only firearms and ammunition that are in proper operational condition and that comply with BBSC's authorized firearms and ammunition protocols.

5.7. Member agrees to keep all firearms unloaded and properly secured when not on the designated firing line.

6. FACILITY USE AND LIMITATIONS

6.1. The Complex is for the exclusive use of BBSC Members and their authorized guests only.

6.2. Member acknowledges that BBSC may restrict or limit access to specific tactical ranges or facilities at any time.

6.3. Member agrees not to make any alterations, additions, or improvements to the Complex.

6.4. Commercial use of the Complex, including but not limited to tactical instruction, filming, or equipment testing, requires prior written authorization from BBSC executive leadership.

7. MEMBERSHIP TERMS

7.1. Membership is subject to approval by BBSC executive leadership and may be denied or revoked at BBSC's sole discretion.

7.2. Membership structure and investment requirements are detailed in the BBSC Membership Policy, which is incorporated into these Terms by reference.

7.3. Membership is non-transferable and non-refundable.

7.4. BBSC reserves the right to modify membership terms, investment requirements, and benefits with notice to Members.

 

8. EQUIPMENT AND TACTICAL ASSETS

8.1. BBSC is not responsible for the loss, theft, or damage of any personal tactical equipment or assets brought onto the Complex.

8.2. Member agrees to secure and monitor their own firearms, ammunition, and other tactical equipment at all times.

8.3. Items left at the Complex may be secured for a reasonable period but may be disposed of if unclaimed.

 

9. IMAGERY AND DOCUMENTATION POLICY

9.1. Photography and video documentation at the Complex require prior authorization from BBSC executive leadership.

9.2. Member acknowledges that BBSC may document activities at the Complex for security, operational assessment, marketing, or other purposes.

9.3. Member grants BBSC permission to use their likeness in photographs, videos, or other media for promotional purposes without compensation.

 

10. GOVERNING LAW AND JURISDICTION

10.1. These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.

10.2. Any dispute arising under or related to these Terms shall be resolved exclusively in the courts of the Commonwealth of Virginia.

 

11. SEVERABILITY

11.1. If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

 

12. ENTIRE AGREEMENT

12.1. These Terms, together with the BBSC Membership Policy, Rules and Regulations, and Standard Operating Procedures, constitute the entire agreement between BBSC and Member regarding the subject matter herein.

12.2. No verbal representations, statements, or inducements apart from these formal documents shall have any force or effect.

 

13. ACCEPTANCE OF TERMS

By applying for membership, or using the Complex or services, Member acknowledges having read, understood, and agreed to these Terms and all incorporated documents.
